This competition is open to professional, serious amateurs and student photographers residing within the United Sates. Submit one or more of your favorite images that were created after January 1st, 2007.

“All entrants waive any claims against Sponsor and its affiliates concerning their respective rights in the Images submitted in this Contest.”
They also say over $25,000 in prizes, but I’m only seeing publicity as a prize.
Does that concern anyone?

Brian, where did you see that wording in the terms? Please post the whole paragraph. I have contacted the ASMP president and legal council to figure out what is going on with this. Seeing as how they have been so influential in changing other contest terms to better the photographer I don’t understand how this language would end up in their contract.

1. How to Enter: To enter, submit one or more original Images created on or after January 01, 2007, in the form of a 72dpi digital file no larger than 800 pixels in longest dimension, via web. All entries must be received by May 5, 2008. All submitted Images must be the fully original creations of the entrants, must be the sole work of the entrants and all persons, places and/or objects appearing within all submitted Images and requiring release for trade or advertising uses must have been fully and properly released. Photographer must have the right to reproduce any image that has been previously published. By entering, all entrants agree to grant the Sponsor the right to use their Images on Sponsor’s web site(s) and in any publicity or promotions for future Sponsor photo competitions. All entrants waive any claims against Sponsor and its affiliates concerning their respective rights in the Images submitted in this Contest. Incomplete entries or entries not satisfying these Official Rules will be automatically disqualified.
4. Prizes: Two (2) First Place prizes (one from the Student Category and one from the Professional Category)† Student Category and one from the Professional Category will be awarded.† The prize will consist of the winning image(s) to be published (layout to be designed by Sponsor, in its sole discretion); publication of the winning Image in a promotional mailer to be sent to 2000 art directors, art buyers and photo editors in New York and other major cities throughout the U.S. (the “Promotional Mailer”); an exhibition of the winning Image in a New York gallery (choice of gallery and time period of exhibition to be in the sole discretion of the Sponsor);
Two (2) Second Prizes (one from the Student Category and one from the Professional Category) consisting of publication of the winning Image in the Promotional Mailer; a exhibition of the winning Image in a New York gallery, in the sole discretion of the Sponsor (choice of gallery and time period of exhibition to be in the sole discretion of the Sponsor). Two (2) Third Prizes (one from the Student Category and one from the Professional Category) consisting of publication of the winning Image in the Promotional Mailer; a exhibition of the winning Image in a New York gallery (choice of gallery and time period of exhibition to be in the sole discretion of the Sponsor). Honorable Mention Prizes (five from the Student Category and five from the Professional Category) consisting of an exhibition of the winning Image in a New York gallery (choice of gallery and time period of exhibition to be in the sole discretion of the Sponsor). Several Judges Choice Prizes consisting of an exhibition of the winning Image in a New York gallery (choice of gallery and time period of exhibition to be in the sole discretion of the Sponsor). No cash redemptions. Prizes are non-transferable and no substitutions will be allowed, except that Sponsor reserves the right to substitute a prize of equal value if prize is unavailable. Sponsor reserves the right to substitute a prize that Sponsor determines to be of equal value in its sole discretion if prize is unavailable.† Winners will be notified by mail and/or telephone on or about June 15th, 2008.

Thanks for posting that Brian. The text you are talking about is at the end of P1. The rights that they are talking about are: “By entering, all entrants agree to grant the Sponsor the right to use their Images on Sponsor’s web site(s) and in any publicity or promotions for future Sponsor photo competitions. All entrants waive any claims against Sponsor and its affiliates concerning their respective rights in the Images submitted in this Contest.”Seems fair to me. They are not asking for rights to sell or give away your photos. They only ask for rights to use your photos “on Sponsor’s web site(s) and in any publicity or promotions for future Sponsor photo competitions.” I have never seen a contest that did not ask for those rights at a minimum.

I agree that’s what they were intending, but that’s not what was said. There would be no legal recourse if I submitted an image, and one of the sponsors abused the rights. I’m not saying that there was/is any ill intent, but that sentence is very broad in it’s scope.
I wasn’t sure if that was something that would raise concern with others or not, that’s why I posted the question.

Yes, I found the information you were looking for. Scroll down to #8 and you will see they define the Sponsor as the ASMP: “Sponsor: The American Society of Media Photographers, Inc., New York Chapter. 101 West 23rd Street #2343, New York, NY 10011”
