Help - New agency agreement

Hi

Today, when I got a new version of agreement between photograper and the agency from one of the agencies that I am working with and I saw some changes in terms that worry me. For example, in case photog and the agency stop collaborating – the agency has an exclusive right to sell your material worldwide for a perioud of up to two years after the termination. Is this a normal situation now? What are the terms in other agencies?

I would say that sucks. one of the more voluble (and successful) Intellectual Property attorneys i know advises that accepting terms such as “standard” will spell your doom and everyone elses…

That term was fairly common (Magnum still has it) and allowed the agency to recoup the investments they made with prints, dupes etc… to distribute your work. In these digital ages it seems a little far fetched, unless the agency is scanning your negs etc….

It’s usually non-exclusive, not exclusive, as otherwise you’re locked into the agency selling on your behalf, even though you’ve left.

Although as John says, in these digital times there seems no need for it at all. You leave and the agency should delete your stuff after tying up any loose ends. Simple. You’d need to get some guarantee on paper that they (and if applicable, their sub-agents) will actually delete the images though, as its easy for digital stuff to hang around on multiple computers, etc.

Thanks veryone. Sion you’re right it’s non-exclusive – I should’ve paid more attention but even if it’s non-exclusive it prevewnts you from submitting your archives to another agency because they will probably want some sort of exclusivity on their territory. I don’t want to accept these terms but I also don’t want to stop working with the agency and I don’t really know how to negotiate better terms.
